- Infringes upon the rights of any third party, including but not limited to copyrights, trademarks, patents, trade secrets, design rights, moral rights or other third party proprietary rights, including privacy and publicity rights. Files/contents should not contain third party copyrighted material, or material that is subject to other third party proprietary rights, unless you have permission from the rightful owner of the material or you are otherwise legally entitled to post the material and to grant MAX CONCEPT TECHNOLOGY LIMITED all of the license rights granted herein;
- Promotes the infringement of copyright or other third party rights, e.g. providing a list of hyperlinks to websites that contain pirated software or media files, hacking/cracking, etc.;
- Contains improper, incorrect and fake contents in any way that contents are with a different preview and incorrect title;
- Is duplicated or contains the same files and contents that already exist on MAX CONCEPT TECHNOLOGY LIMITED;
- Contains software viruses or any other malicious computer code, files or programs designed to interrupt, destroy or alter the functionality of any computer software or hardware or telecommunications equipment owned by another party;
- Is offensive, abusive, threatening, harassing, stalking, promoting violence, racism, harm, hatred or bigotry against any group or individual;
- Is libellous, defamatory or promotes information that you know is false or illegal;
- Violates the privacy of others, including but not limited to posting the photograph of another person without that person’s consent;
- Solicits information from anyone under the age of 18;
- Is pornographic, sexually explicit or contains nudity;
- Is or contains an advertisement, a marketing initiative, solicitation of a business, or otherwise significantly connected with any commercial purpose;
- Is unlawful or illegal, criminal or tortuous in nature (such as child pornography, fraud, gambling).
In your use of the Service, you will comply with all applicable laws.
MAX CONCEPT TECHNOLOGY LIMITED reserves the right to discontinue any aspect of the Service at any time.

4. Your Use of Content

In addition to the general restrictions above, the following restrictions and conditions apply specifically to your use of Content.

5.Your Content and Conduct

As a MAX CONCEPT TECHNOLOGY LIMITED account holder you may submit Content to the Service (wallpapers, ringtones, etc). You understand that MAX CONCEPT TECHNOLOGY LIMITED does not guarantee any confidentiality with respect to any Content you submit.
You shall be solely responsible for your own Content and the consequences of submitting and publishing your Content on the Service. You affirm, represent, and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish Content you submit; and you license to MAX CONCEPT TECHNOLOGY LIMITEDall patent, trademark, trade secret, copyright or other proprietary rights in and to such Content for publication on the Service pursuant to these Terms of Service.
You retain all of your ownership rights in your Content. You further agree that Content you submit to the Service will not contain third party copyrighted material, or material that is subject to other third party proprietary rights, unless you have permission from the rightful owner of the material or you are otherwise legally entitled to post the material and to grant MAX CONCEPT TECHNOLOGY LIMITED all of the license rights granted herein.
MAX CONCEPT TECHNOLOGY LIMITED does not endorse any Content submitted to the Service by any user or other licensor, or any opinion, recommendation, or advice expressed therein, and MAX CONCEPT TECHNOLOGY LIMITED expressly disclaims any and all liability in connection with Content. 6.Account Termination Policy

MAX CONCEPT TECHNOLOGY LIMITED will terminate a user’s access to the Service if, under appropriate circumstances, the user is determined to be a repeat infringer.
MAX CONCEPT TECHNOLOGY LIMITED reserves the right to decide whether Content violates these Terms of Service for reasons other than copyright infringement, such as, but not limited to, pornography, obscenity. MAX CONCEPT TECHNOLOGY LIMITED may at any time, without prior notice and in its sole discretion, remove such Content and/or terminate a user’s account for submitting such material in violation of these Terms of Service.

MAX CONCEPT TECHNOLOGY LIMITED MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THIS SITE’S CONTENT OR THE CONTENT OF ANY SITES LINKED TO THIS SITE AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICES, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVICES, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICES BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES. MAX CONCEPT TECHNOLOGY LIMITED DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE SERVICES OR ANY HYPERLINKED SERVICES OR FEATURED IN ANY BANNER OR OTHER ADVERTISING, AND MAX CONCEPT TECHNOLOGY LIMITED WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES. AS WITH THE PURCHASE OF A PRODUCT OR SERVICE THROUGH ANY MEDIUM OR IN ANY ENVIRONMENT, YOU SHOULD USE YOUR BEST JUDGMENT AND EXERCISE CAUTION WHERE APPROPRIATE.

8.Limitation of Liability

IN NO EVENT SHALL MAX CONCEPT TECHNOLOGY LIMITED, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICES, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVICES, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICES BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION. YOU SPECIFICALLY ACKNOWLEDGE THAT MAX CONCEPT TECHNOLOGY LIMITED SHALL NOT BE LIABLE FOR CONTENT OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.

9.Indemnity

To the extent permitted by applicable law, you agree to defend, indemnify and hold harmless MAX CONCEPT TECHNOLOGY LIMITED, its parent corporation, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms of Service; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your Content caused damage to a third party. This defense and indemnification obligation will survive these Terms of Service and your use of the Service.

10.Ability to Accept Terms of Service

You affirm that you are either more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Service, and to abide by and comply with these Terms of Service.

11.Assignment

These Terms of Service, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by MAX CONCEPT TECHNOLOGY LIMITED without restriction.

12.General

Terms of Service shall be deemed a further or continuing waiver of such term or any other term, and MAX CONCEPT TECHNOLOGY LIMITED’s failure to assert any right or provision under these Terms of Service shall not constitute a waiver of such right or provision. MAX CONCEPT TECHNOLOGY LIMITED reserves the right to amend these Terms of Service at any time and without notice, and it is your responsibility to review these Terms of Service for any changes. Your use of the Service following any amendment of these Terms of Service will signify your assent to and acceptance of its revised terms. YOU AND MAX CONCEPT TECHNOLOGY LIMITED AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SERVICES MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

13.Information Storage and Synchronization

1. You acknowledge and agree to store information relating to use of Our Products into your own end-device, which will occupy some room of the end-device. We reminds that you should make your choice as to whether to set passwords for using Our Services in order to protect information security according to your needs.
2. You acknowledge and agree that the information generated during your use of Our Products may be stored and processed by us or its affiliates or service providers through their servers. As Our Products can be downloaded and used by users worldwide, the servers may be located in China (for the purpose of this clause, excluding HK, Macao and Taiwan) or other countries/regions based on the need of providing the service, in compliance with laws and regulations.
3. If you use Our Products and sign in your account at your end-device, the information already stored in the end-device if expressly confirmed by you will be added to your account and stored in our servers. Your account will be bound to the end-device as a default status and you can unbind the account and the end-device in the setting by logging out the account.
4. When you use Our Products after signing in your account, any direct modification of information in end-device (if stored in our server according to the preceding section), will be synchronized automatically between end-device and server in its lately modified form. Therefore, if you are using an end-device which is not owned by you, please be sure to log out timely and make necessary adjustment to your settings so as to avoid any leakage of personal information or privacy of yours or others.
5. Our system stores, backups and provides recovery of information based on your operation. You should read operation guidelines carefully to well understand the default setting of the system and adjust it at your own will so as to use Our Products in a proper way. We remind that even if we will take necessary measures to store and protect your data, you should backup your data on your own. We shall not be responsible for picture and other information you delete or fail to successfully store.
